By entering and using the facilities at ACTIVO, you acknowledge and agree to the following terms. This legal disclaimer limits the liability of ACTIVO and outlines your responsibilities as a user of our services and facilities.

1. Assumption of Risk

Use of ACTIVO’s facilities—including but not limited to the gym, sauna, ice baths, and functional training areas—may involve risks of injury, illness, dehydration, muscle strain, heart-related incidents, or other health conditions. By entering the premises or participating in any activity, you voluntarily assume all risks associated with physical activity and facility use.

2. Medical Responsibility

You affirm that you are in good physical condition and not aware of any medical condition that would prevent you from safely engaging in exercise or recovery activities. You are solely responsible for consulting a physician before starting any fitness or recovery program. ACTIVO does not provide medical advice or treatment.

3. Release of Liability

To the fullest extent permitted by law, you agree to release, waive, discharge, and hold harmless ACTIVO, its owners, employees, contractors, partners, and affiliates from any and all liability for injuries, damages, losses, or expenses—including legal fees—that may arise from your participation in any activity or use of the facility.

4. Use of Facilities and Equipment

All users are expected to follow safety instructions, use equipment responsibly, and report any damages or hazards immediately. ACTIVO is not responsible for accidents caused by improper use or failure to follow posted rules or staff instructions.

5. Personal Property

ACTIVO is not responsible for the loss, theft, or damage of any personal belongings brought into the facility.

6. Sauna & Ice Bath Use

Use of the sauna and ice baths is voluntary and may pose health risks to individuals with pre-existing medical conditions. You agree to use these facilities at your own risk and discretion. If you experience discomfort, dizziness, or unusual symptoms, exit immediately and seek medical attention.

7. Minors

Minors must be accompanied by a parent or legal guardian and may only participate in activities with appropriate consent and supervision. The guardian assumes full responsibility for the minor’s conduct and safety.

8. Photography and Media

ACTIVO may occasionally take photos or videos within the facility for promotional purposes. By entering the premises, you consent to the use of your image, unless you notify us in writing.

9. Changes to This Disclaimer

ACTIVO reserves the right to update this disclaimer at any time. Continued use of the facility after updates constitutes acceptance of the revised terms.

These Terms and Conditions ("Terms") govern your use of all services and facilities provided by ACTIVO, including but not limited to gym equipment, classes, sauna, ice baths, recovery spaces, and digital services such as our website and online booking system. By using any of our services or accessing our premises, you agree to these Terms.

1. Acceptance of Terms

By visiting ACTIVO or using our services (online or in person), you agree to comply with and be bound by these Terms. If you do not agree with any part of the Terms, you should not use our services or facilities.

2. Membership and Access

• Members must be at least 18 years old, or have written consent from a legal guardian.

• All users must complete a waiver and intake form before using any facility.

• ACTIVO reserves the right to deny or revoke membership or access at any time for violation of policies or behavior deemed unsafe or disrespectful.

3. Health and Safety

• By participating in any fitness or recovery activity, you confirm that you are in good physical condition and have no medical issues that prevent safe participation.

• You assume full responsibility for any risk of injury or health issues that may result from use of the facility.

• ACTIVO is not responsible for injuries resulting from misuse of equipment or failure to follow instructions.

• The use of the sauna and ice bath is at your own risk. These services are not recommended for individuals with cardiovascular, respiratory, or other medical conditions unless cleared by a physician.

4. Facility Rules

• Appropriate clothing and behavior are required at all times.

• Equipment must be used safely and returned to its proper place after use.

• Food and drinks (except water) are not allowed in workout areas.

• Personal items should be kept in designated areas—ACTIVO is not responsible for lost, stolen, or damaged belongings.

• Please follow all posted signage and staff instructions.

5. Booking and Cancellations

• Classes and recovery sessions must be booked in advance using our app or website.

• Cancellations must be made at least [insert policy time, e.g., 4 hours] prior to the class/session. Late cancellations or no-shows may incur a fee.

• ACTIVO reserves the right to cancel or reschedule classes and services as needed.

6. Payments and Fees

• All memberships, passes, and service fees must be paid in full prior to use.

• Prices are subject to change, and members will be notified of any updates.

• No refunds are issued for unused sessions or early terminations unless required by law.

7. Privacy Policy

8. Intellectual Property

All branding, media, content, and designs associated with ACTIVO are the property of ACTIVO and may not be reproduced without permission.

ACTIVO shall not be liable for any direct, indirect, incidental, or consequential damages or injuries resulting from use of our services or facilities. You agree to release and indemnify ACTIVO from any claims or liabilities arising from your participation.
